How NY Hope collects, uses, shares, and protects the personal information you provide.

1. Scope
This Privacy Policy explains how NY Hope Inc. collects, uses, shares, and protects personal information when you visit nyhope.org, submit an intake form, book a consultation, or otherwise interact with NY Hope. It applies to visitors and users located in New York, New Jersey, Connecticut, Pennsylvania, and elsewhere, and describes certain rights that apply specifically to residents of particular states, as set out in section 8.
2. Information collected
We collect the following categories of information, depending on how you interact with the Site.
2.1 Matter and intake information
- Contact information: full name, email address, phone number, and borough, city, or general location.
- Matter information: whether you are an individual or a business, the type of legal issue, whether you have received court papers, whether there is a court date or legal deadline and its date, the name of any creditor, lender, or opposing party, the approximate amount in dispute or owed, and a description of your issue.
- Contact preferences: your preferred contact method and best time to reach you.
2.2 Uploaded documents
Documents you choose to upload, such as court papers, notices, contracts, statements, judgments, or loan documents, which may themselves contain sensitive personal or financial information.
2.3 Technical and device information
Information collected automatically when you visit the Site, such as IP address, browser type, device information, and pages visited.
2.4 Cookies and tracking information
We use cookies and similar tracking technologies as described in our
Cookie Policy, which explains the categories of cookies used and how you can manage your preferences.
2.5 Sources of information
We collect personal information directly from you, automatically from your use of the Site, from a person authorised to submit an enquiry on your behalf and, where relevant, from participating attorneys and service providers involved in processing your enquiry.
3. How information is used
- To process your intake, determine administratively whether the type and location of the enquiry fall within the categories currently supported by NY Hope, and, where appropriate, facilitate an introduction to an independent attorney.
- To contact you regarding your submission, by phone, email, or another channel according to your stated preference.
- To assist with the administration of your matter where an attorney has agreed to represent you.
- To operate, maintain, and improve the Site.
- To comply with legal obligations and to protect the rights, property, and safety of NY Hope, its users, and others.
4. How information is shared
4.1 Attorneys in the NY Hope network
Where appropriate, we share your intake information and uploaded documents with an attorney or attorneys in our network for the purpose of assessing whether they are able to assist you, including for conflict-of-interest checking. Once you engage an attorney directly, that attorney's own privacy and confidentiality obligations, including the attorney-client privilege, govern the attorney's handling of your information.
4.2 Service providers
We share information with vendors who host the Site, process intake submissions, or provide similar operational support, under obligations to protect that information and use it only to provide services to NY Hope.
4.3 Legal disclosures
We may disclose information where required by law, regulation, subpoena, or court order, or where necessary to protect the rights, property, or safety of NY Hope, our users, or the public. If NY Hope is involved in a merger, acquisition, or sale of assets, information may be transferred as part of that transaction, subject to this Policy or a successor policy.
We do not sell your personal information for money. Where this Policy uses the term "sale" in a state-law-specific sense in section 8, that section explains the scope of that term for the relevant state.
5. Sensitive information
Documents you upload, such as court papers, loan documents, and financial statements, often contain sensitive identifiers such as Social Security numbers or full financial account numbers. We recommend redacting such identifiers before uploading where they are not necessary for an attorney to assess your matter. We apply administrative, technical, and physical safeguards designed to protect uploaded documents, as described in section 7. As explained in the Terms of Use, information you submit to NY Hope may not be protected by attorney-client privilege, which ordinarily arises only in connection with communications with an attorney for the purpose of obtaining legal advice.
6. Data retention
We retain intake information and uploaded documents for as long as reasonably necessary to fulfil the purposes described in this Policy, including any period necessary to introduce you to an attorney, to comply with legal or regulatory obligations, and to resolve disputes. Where information is no longer needed for these purposes, we take reasonable steps to delete or de-identify it.
7. Data security
We use reasonable administrative, technical, and physical safeguards designed to protect personal information against unauthorized access, disclosure, alteration, or destruction. No method of transmission or storage is completely secure, and we cannot guarantee absolute security. Email, SMS and messaging platforms may not always provide a completely secure means of communication, and you should avoid sending unnecessary sensitive identifiers through these channels. If you become aware of a security concern involving your information, please contact us using the details in section 12.
8. State-specific privacy rights
Depending on where you live, and subject to the applicability thresholds and exemptions in the relevant state law, you may have some or all of the following rights over the personal information we hold about you: the right to confirm whether we process your personal information, to access it, to correct inaccuracies, to request deletion, to obtain a portable copy, and to opt out of certain processing such as targeted advertising, the sale of personal information, or profiling that produces legal or similarly significant effects. To exercise a right described in this section, contact us using the details in section 12. We will not discriminate against you for exercising a privacy right.
We may take reasonable steps to verify your identity before acting on a privacy request. Where applicable law permits an authorised agent to submit a request on your behalf, we may require evidence of that authority. If we decline a request, we will provide the reason and information about any available appeal process where required by law.
8.1 New York
New York does not currently have a comprehensive consumer privacy statute of general application. NY Hope complies with the New York SHIELD Act's data security requirements in respect of private information of New York residents that we hold, regardless of the volume of information involved.
8.2 New Jersey
If you are a New Jersey resident, you may have rights under the New Jersey Data Privacy Act, in effect since 15 January 2025, including the rights of access, correction, deletion, portability, and opt-out described in the introduction to this section, to the extent NY Hope meets the applicability thresholds of that Act.
8.3 Connecticut
If you are a Connecticut resident, you may have rights under the Connecticut Data Privacy Act, in effect since July 2023, including the rights of access, correction, deletion, portability, and opt-out described in the introduction to this section, to the extent NY Hope meets the applicability thresholds of that Act. Connecticut law imposes heightened requirements around the processing of sensitive data, which is relevant to the documents you may choose to upload through our intake form.
8.4 Pennsylvania
Pennsylvania does not currently have a comprehensive consumer privacy statute of general application. We handle Pennsylvania residents' information in accordance with the general principles set out in this Policy and applicable Pennsylvania and federal law.
8.5 Targeted advertising opt-out
Where applicable, you may opt out of targeted advertising, the sale of personal information, or profiling that produces legal or similarly significant effects, using the Cookie Settings link referenced in section 2.4, or by contacting us using the details in section 12.
9. Marketing communications
We will only send you marketing or promotional communications, such as news or legal-information updates, if you separately opt in using the marketing consent checkbox described at the point of collection. You may unsubscribe from marketing communications at any time using the link provided in each communication or by contacting us using the details in section 12. Marketing consent is separate from, and not required for, use of our intake process.
Where we communicate with you regarding your enquiry, we will do so using the contact details and communication method you provide, in accordance with this Policy and applicable law.
10. Children's privacy
The Site is not directed to, and is not intended for use by, children under the age of 18. We do not knowingly collect personal information from children under 18. If you believe a child has provided us with personal information, please contact us so that we can address it.
11. Changes to this Policy
We may update this Policy from time to time. The "Last updated" date at the top of this page will reflect the most recent revision. Material changes will be reflected on this page, and where required by law, we will provide additional notice.
