1. Acceptance of the Terms
These Terms of Use, together with the Privacy Policy incorporated by reference, govern access to and use of the website located at nyhope.org and any related intake forms, telephone intake, or consultation booking (together, the "Site") operated by NY Hope Inc. ("NY Hope", "we", "us" or "our"). By accessing the Site, submitting an intake form, or booking a consultation, you agree to be bound by these Terms. If you do not agree, do not use the Site.
2. Description of NY Hope
NY Hope operates a legal intake and attorney-connection platform. It receives enquiries from individuals and businesses and may introduce them to independent attorneys based on objective administrative criteria, such as jurisdiction, stated practice area and availability.
3. Confirmation that NY Hope is not a law firm
NY Hope is not a law firm and does not practise law. NY Hope operates independently from the attorneys participating in its network.
4. No legal advice
NY Hope does not practise law, does not give legal advice, and does not represent you in any legal matter. The information on the Site, including the plain-language guides, is provided for general informational purposes only and should not be relied upon as legal advice.
5. No attorney-client relationship on submission
No attorney-client relationship is created by browsing the Site, submitting an intake form, uploading documents, or booking a consultation. An attorney-client relationship, if any, is formed only when confirmed to you in writing by an attorney or an authorised representative of that attorney's practice.
6. Eligibility and geographical scope
The Site is intended for individuals and businesses seeking legal assistance in connection with matters in New York, New Jersey, Connecticut or Pennsylvania. You must be at least 18 years old, or the age of majority in your state, to submit an intake form on your own behalf. If you are submitting on behalf of a business, you confirm that you are authorised to do so and to bind that business to these Terms.
7. Accuracy of intake information
When you submit an intake form, you agree to provide accurate, current and complete information, including your name, contact details, a description of your legal issue, and, where applicable, details of any court papers, deadlines, creditors, or opposing parties. NY Hope relies on the accuracy of what you submit to process your intake and, where appropriate, to introduce you to an attorney in its network. Inaccurate or incomplete information may delay or prevent that process.
8. Urgent matters and legal deadlines
Legal deadlines can move quickly and are not paused while your intake is reviewed. If you have been served with a lawsuit, received a foreclosure complaint, a judgment, a garnishment notice, or have an upcoming court date, submitting an intake form is not a substitute for timely action. You remain solely responsible for meeting any deadline, responding to any court papers, and protecting your own legal rights until and unless an attorney has confirmed representation to you in writing.
NY Hope is not an emergency legal service and does not guarantee that an intake will be reviewed or responded to within any particular period.
9. Document uploads
You may optionally upload documents such as court papers, notices, contracts, statements, judgments or loan documents to support your intake. By uploading a document, you confirm that you have the right to share it and that doing so does not infringe the rights of any third party or breach any confidentiality obligation you owe. Where practical, you are encouraged to redact Social Security numbers, full account numbers, and other highly sensitive identifiers before uploading, except where an identifier is necessary for the attorney to assess your matter.
10. Rights over uploaded content
You retain any rights you hold in documents you upload. By uploading them, you authorise NY Hope to host, copy, process and disclose them only to the extent reasonably necessary to process your enquiry, facilitate an attorney introduction, provide related administrative services and comply with applicable law.
11. Confidentiality and attorney-client privilege caution
NY Hope handles the information you submit in accordance with its Privacy Policy and applicable law, and applies reasonable safeguards designed to protect it.
Do not submit information you consider highly confidential unless it is reasonably necessary for the intake process. Information you submit to NY Hope may not be protected by attorney-client privilege. Attorney-client privilege, where it applies, ordinarily arises only in connection with communications with an attorney for the purpose of obtaining legal advice, and not in connection with your submission to NY Hope as an intake platform.
12. Conflict checks
Where you provide the name of a creditor, lender, opposing party, or collection company, that information may be used to help an attorney in our network conduct a conflict-of-interest check before accepting your matter. Providing this information does not mean that any attorney has agreed to represent you, and NY Hope does not itself determine whether a conflict of interest exists.
13. Attorney network and introduction process
NY Hope will review your intake and, where appropriate, may introduce you to one or more independent attorneys whose stated licensing jurisdiction and practice areas appear to correspond with the information you submitted. NY Hope does not rank, recommend, endorse, or guarantee any attorney.
Introductions may be based on objective administrative information, including the location and general category of the matter, the attorney's stated jurisdiction and practice areas, availability, capacity and the results of any conflict check conducted by the attorney. NY Hope does not assess the merits of a matter or determine which attorney is professionally best suited to represent a user.
14. Independent status of attorneys
Attorneys participating in the NY Hope network are independent legal professionals. They are not employees, partners, agents, or representatives of NY Hope. NY Hope does not control their legal advice, professional judgment, fees, engagement decisions, or handling of any matter. In particular, NY Hope does not: provide legal advice; negotiate legal fees on your behalf; receive or hold client trust money; make decisions about legal strategy; guarantee the availability of any attorney; or guarantee any outcome.
15. No exclusivity
You are not required to engage an attorney introduced through NY Hope and remain free to seek legal assistance from any other attorney or legal-services provider.
16. Attorney verification limitation
NY Hope may review publicly available information concerning an attorney's licensing status and stated practice areas. Users remain responsible for deciding whether to engage an attorney and may independently verify an attorney's credentials and disciplinary history with the relevant licensing authority.
17. Fees and compensation disclosures
NY Hope does not charge a fee merely to submit an intake form. An attorney may charge for an initial consultation or for other legal services, and any applicable charge must be disclosed to you by that attorney before the consultation is confirmed. Any fee arrangement for legal representation is a matter between you and the attorney who agrees to represent you, and will be set out in that attorney's own engagement letter or fee agreement.
18. No guarantee of representation or outcome
NY Hope does not guarantee that:
- an attorney will be available;
- an introduction will be made;
- an attorney will accept your matter;
- representation will commence within a particular period; or
- any particular result or outcome will be achieved.
19. Intellectual property
The Site, including its text, design, graphics, logos and the NY Hope name and marks, is owned by or licensed to NY Hope and is protected by intellectual property law. You may view and use the Site for your own personal or internal business purpose of seeking legal assistance. You may not copy, reproduce, distribute, or create derivative works from the Site's content for any other purpose without NY Hope's prior written consent.
20. Third-party links
The Site may contain links to third-party websites or resources, including plain-language guides and articles. NY Hope does not control and is not responsible for the content, accuracy, or availability of any third-party site. Inclusion of a link does not imply endorsement.
21. Prohibited uses
- Submitting false, misleading, or fraudulent information through an intake form.
- Using the Site to submit another person's information without that person's knowledge and authorisation.
- Attempting to interfere with, disable, or overburden the Site or its underlying systems.
- Scraping, harvesting, or otherwise extracting data from the Site by automated means without prior written consent.
- Using the Site for any unlawful purpose, or in a manner that infringes the rights of NY Hope or any third party.
22. Disclaimer of warranties
The Site and all information on it, including the plain-language guides, are provided on an as-is and as-available basis. NY Hope makes no warranty, express or implied, as to the accuracy, completeness, or currency of any information on the Site, and disclaims all warranties to the fullest extent permitted by law, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
23. Limitation of liability
To the fullest extent permitted by applicable law, NY Hope will not be liable for any indirect, incidental, consequential, special, or punitive damages, or for any loss of data, revenue, or business opportunity, arising out of or relating to your use of the Site, any intake submission, or any introduction to an attorney in the network, even if advised of the possibility of such damages. Nothing in these Terms limits liability that cannot lawfully be limited or excluded under the law of your state, including any consumer protection statute that applies to you.
24. Indemnification
You agree, to the extent permitted by applicable law, to indemnify NY Hope against third-party claims arising directly from information or documents that you knowingly submit without authority, your fraudulent or unlawful use of the Site, or your material breach of these Terms.
25. Governing law and venue
These Terms are governed by the law of the State of New York, without regard to its conflict of law principles, except to the extent a mandatory consumer protection law of your home state applies to you and cannot be displaced by this choice of law. You and NY Hope agree that any dispute arising out of these Terms or your use of the Site will be brought exclusively in the state or federal courts located in New York County, New York, and each party consents to the personal jurisdiction of those courts, except where applicable law requires otherwise for consumers located in New Jersey, Connecticut, or Pennsylvania.
26. Changes to the Terms
NY Hope may update these Terms from time to time. The "Last updated" date at the top of this page will reflect the most recent revision. Continued use of the Site after a revision takes effect constitutes acceptance of the updated Terms.
27. Termination
NY Hope may suspend or terminate your access to the Site at any time, with or without notice, including where NY Hope reasonably believes you have violated these Terms.
28. Severability and entire agreement
If any provision of these Terms is held unenforceable, the remaining provisions will continue in full force and effect. These Terms, together with the Privacy Policy, constitute the entire agreement between you and NY Hope regarding use of the Site and supersede any prior agreement on that subject.
